2. Use License

Permission is granted to temporarily access and use Vivify for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software
• Remove any copyright or proprietary notations
• Transfer the materials to another person or "mirror" the materials on any other server

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

5. Disclaimer

The materials on Vivify are provided on an 'as is' basis. Vivify makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

6. Limitations

In no event shall Vivify or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Vivify.

7. Modifications

Vivify may revise these terms of service at any time without notice. By using this service, you are agreeing to be bound by the then current version of these terms of service.

8. Content Moderation & Prohibited Content

Vivify AI implements automated content moderation to maintain a safe and respectful environment for all users. Our moderation system reviews all user-generated prompts before processing.

Prohibited Content includes:

• Profanity and offensive language
• Explicit sexual content, pornography, or sexually explicit material
• Content promoting violence, hate speech, or discrimination
• Content that exploits or harms minors
• Content that infringes on intellectual property rights
• Spam, malware, or deceptive content

Allowed Content includes:

• Artistic nude content in an educational or fine art context
• Horror, thriller, or dramatic creative content
• Fashion and dance content
• All other creative and appropriate content

Violation of these content guidelines may result in immediate termination of your account without refund. We reserve the right to remove any content that violates these terms.

9. AI-Generated Content Ownership

Content you create using Vivify AI belongs to you, subject to the following conditions:

• You must have legal rights to any images you upload
• AI-generated content may not be used for illegal purposes
• Premium subscribers receive full commercial usage rights
• Free tier users receive personal, non-commercial usage rights
• We may use anonymized content for service improvement
